Terms of Use for Buyers

Preamble

The Bio Bairro Marketplace, managed by the Municipality of Idanha-a-Nova, is a digital platform that enables registered buyers to purchase products from registered professional sellers. Transactions take place directly between the buyer and the seller, with the Marketplace acting solely as an intermediary, facilitating the process through the technological tools provided by the platform.
By using the platform, the buyer fully accepts these General Terms and Conditions of Use (GTCU), which are intended to govern the rights, duties and responsibilities of buyers.

1. Purpose
These Terms and Conditions are intended to govern the use of the Bio Bairro Marketplace by buyers, setting out the conditions for access, purchase, payment and receipt of products, as well as defining their obligations and rights in accordance with applicable legislation.

2. Registration and Access to the Service
2.1. Eligibility and Registration
Access to the platform is restricted to adults acting as end consumers (within the meaning of Law No. 24/96 of 31 July), or to duly registered companies. To access the service, the buyer must create an account, providing true and complete information.

2.2. Login Details
The buyer is responsible for keeping their login details (username and password) confidential. In the event of loss or unauthorised use, the buyer must immediately notify the platform to prevent any fraudulent use of the account.

2.3. Account Suspension or Closure
The Management Team of the Marketplace Bio Bairro platform may suspend or close a buyer’s account in the event of a breach of these Terms and Conditions of Use, including fraudulent behaviour, bad faith in reviews, or failure to meet payment obligations.

2.4 Consumer Helplines
In accordance with Decree-Law No. 59/2021 of 14 July, the Bio Bairro Marketplace provides consumers with helplines for customer assistance and support, at no additional cost beyond the standard call charge. You can contact us on working days by calling 277 200 570 or emailing biobairro@idanha.pt during opening hours from 9.00 am to 1.00 pm and from 2.00 pm to 5.00 pm.
The use of premium-rate telephone lines is not permitted, thereby ensuring that consumers can contact us without incurring any extra charges. Should you have any queries or require support, you may also use other contact channels, such as email and the platform’s contact form.

3. How the Service Works
3.1. Searching for and Purchasing Products
Buyers can search for products across different categories on the platform, using search and sorting filters to find products that suit their needs. After selecting the desired product, the buyer can add the item to their basket and proceed with the purchase process.

3.2. Interaction with Sellers
The platform allows buyers to contact sellers directly via a messaging system to clarify any queries or obtain further information about the products. Communication must be conducted in good faith and in accordance with the established terms of conduct.

3.3. Completion of the Purchase
The buyer must check all information relating to the purchase (product, quantity, price, terms and delivery address) before confirming the order. Confirmation of the purchase implies acceptance of the general terms and conditions of sale (GTC) and the seller’s specific terms and conditions.

4. Payment and Costs
4.1. Price and Taxes
The total price of the purchase will be displayed in euros (€), including all applicable taxes (e.g. VAT) and any delivery charges. The buyer will be clearly informed of the total amount before finalising the purchase.

4.2. Payment Methods
The platform offers various payment options, such as credit cards, debit cards and bank transfers. All payments are processed via secure systems with data encryption, ensuring the protection of the buyer’s financial information.

4.3. Delivery Costs
Delivery costs vary depending on the delivery location and the chosen delivery method. These costs are the responsibility of the seller and will be presented to the buyer clearly and unambiguously before the order is confirmed.

5. Delivery of Products
5.1. Delivery Times
The delivery time is determined by the seller and depends on the delivery method chosen by the buyer. This information will be provided at the time of purchase. Delivery will be made to the location chosen by the buyer, who is responsible for ensuring that all details provided for this purpose are correct.

5.2. Receipt and Inspection of Products
Upon delivery, the buyer must check that the products comply with the order. Should the buyer identify any defect or error in the order, they must report the issue via the platform within 14 days of receipt.

6. Returns and Refunds
6.1. Right of Withdrawal
Under the terms of Decree-Law No. 24/2014 of 14 February, the buyer has the right to withdraw from the purchase within 14 days of the date of receipt of the product, without having to justify their decision. To exercise this right, the buyer must notify their intention via the platform.

6.2. Return Conditions
Returned products must be in the same condition as when they were received, showing no signs of use and in their original packaging. The seller is responsible for accepting the return and issuing a refund within a maximum of 14 days of receiving the returned product.

6.3. Refunds
Refunds will be made via the same payment method used for the purchase, unless otherwise agreed. The cost of returning the goods may be borne by the buyer, except where the return is due to a fault or error with the product.

7. Buyer’s Responsibilities
7.1. Accuracy of Information
The buyer undertakes to provide accurate and complete information during the registration and purchase process, in particular regarding the delivery address and payment details.

7.2. Compliance with the Terms of Use and General Terms and Conditions of Sale
The buyer must comply with these Terms of Use and the General Terms and Conditions of Sale (GTCS) established by the seller. Any breach may result in the suspension or closure of the account.

8. Complaints and Dispute Resolution
8.1. Complaints
The buyer may submit complaints regarding the quality of the products or the service provided by the seller via the platform.

8.2. Out-of-Court Dispute Resolution
In the event of a dispute between the buyer and the seller, the parties are encouraged to make use of the Alternative Dispute Resolution mechanisms provided for in Decree-Law No. 144/2015, which regulates mediation and arbitration in consumer disputes. If an amicable resolution is not possible, the parties may bring the matter before the competent courts.

9. Intellectual Property
9.1. Platform Content
All content on the platform, including text, graphics, logos, images and design, is protected by copyright and related rights, in accordance with the Code on Copyright and Related Rights. The use of such content without authorisation is strictly prohibited.

10. Final Provisions
10.1. Amendments to the Terms of Use
The Management Team of the Marketplace Bio Bairro platform reserves the right to amend these Terms of Use at any time, notifying users of the changes electronically or via the platform. Continued use of the platform following the publication of the amendments shall be deemed acceptance of the new terms.

In addition, consumers have a number of alternative dispute resolution options available to them, including:
• CIAB – Centre for Consumer Information, Mediation and Arbitration: CIAB
• CIMPAS – Centre for Insurance Information, Mediation and Ombudsman Services: CIMPAS
Consumers may also choose to use the online platform provided by the European Union to submit complaints regarding disputes. The Neighbourhood Management Team provides information on how to exercise your right to lodge a complaint with an official, impartial third party. If you are not satisfied with the purchase of a good or service, or with the proposed solution, you can visit the official European Union ODR Platform website to submit your complaint.
